Legal claims which are not proactively managed can become unnecessarily prolonged and prove expensive. Early consideration of alternative means to resolving disputes is important, not just because it can save legal costs, delay and the uncertainty attached to any litigated claim, but because it may also help save relationships in the long term.  A mediated settlement can also produce solutions that are simply not within the power of a court to confer.
