National law firm, Enable Law has settled a case for a claimant who was involved in an accident in which they sustained multiple life altering injuries, including fractures, internal injuries and a traumatic brain injury.
At the time of the accident the claimant was given a ten percent chance of survival.
Tim Jones (Legal Director) and Heidi Grute (Litigation Executive) of Enable Law’s Personal Injury team were instructed by the claimant after the accident. Together they worked with the claimant to successfully achieve a result that will benefit the claimant for the rest of their life.
The claim was complex from the outset and involved many moving parts. The claimant was involved in a collision whilst crossing the road which involved two other vehicles and a local authority which had allocated a coach pick up point nearby that required her to cross a busy 60mph road.
The Enable Law team carried out investigations to ascertain the merits of pursuing parties involved and it was decided that there was enough evidence to pursue the driver who hit the claimant and the local authority, Somerset County Council.
Liability was strenuously denied by both defendants and the claim became highly contested on all fronts. Enable Law’s client argued that the local authority had been made aware of the dangers the coach pick-up points which impacted pedestrians’ ability to cross the road. Additionally, it was argued by the claimant that the local authority had acknowledged this previous complaint and carried out an unsuitable risk assessment and failed to implement any changes nor flag the complaint appropriately.
The case went to court and lasted four days. Rob Weir QC was instructed by Enable Law to represent the claimant. On day 3 of the trial Enable Law successfully obtained a settlement for the claimant which was double the previous offer made before trial.
When asked about the settlement, Tim Jones commented: “This was an interesting case as it involved so many different issues. We were certain the offers given pre-trial were insufficient and we advised our client to push further. We are incredibly proud of the outcome for our client in such a complex case. The settlement will go towards supporting the claimant with therapies and adjustments to cater for the injuries sustained by the accident.”
