Before her accident, Marian* was a highly active and accomplished individual. She was a writer and balanced a career in teaching with her PhD studies. She was also a skilled dancer and dance teacher, and had a strong reputation as a confident orator and writer with an established social media presence.

After winning a competition, Marian was rewarded with a motorcycle tour abroad. What should have been an exciting and memorable experience instead led to a life‑changing injury.

How the accident happened

During the organised motorcycle tour, Marian was involved in an accident which caused her to lose consciousness and sustain a traumatic brain injury. She later came to believe that the incident was preventable and that the organisation responsible for the tour had failed to ensure her safety.

As a result, she sought legal advice and brought a claim against the organisation she held responsible.

The impact of the injury

Following the accident, Marian required medical treatment for a brain injury. While the immediate clinical response was one of cautious optimism, it soon became clear that the impact of her injury would be long‑term and complex.

Marian developed ongoing post‑concussion symptoms along with Functional Cognitive Disorder. These conditions had a profound and wide‑ranging impact on her day‑to‑day life.

She experienced:

  • Persistent cognitive difficulties affecting memory, concentration, and processing;
  • Fatigue and balance problems;
  • A significant reduction in her ability to carry out tasks that had once come naturally.

Despite her previously high level of functioning, Marian found herself struggling to maintain her professional and personal activities.

Effect on Marian’s work and independence

Marian’s injuries significantly affected her career and independence.

As a teacher, she required sustained concentration and mental clarity, both of which were impacted by her symptoms. She was forced to take time away from work and faced ongoing challenges in returning to her role.

Her academic ambitions were also disrupted, and she had to pause her PhD studies.

Outside of work, her balance issues and fatigue affected her ability to continue professional dancing. Activities she once enjoyed with ease became difficult, and her confidence was understandably impacted.

How Enable Law supported Marian

Marian approached Enable Law in search of answers, accountability, and support. Her case was led by Leigh Woodham, who specialises in complex injury claims.

Marian’s case was based on the belief that the accident during the organised motorcycle tour was preventable and resulted from failures by the responsible organisation to ensure appropriate safety measures were in place.

Given the nature of Marian’s symptoms, Leigh obtained detailed medical evidence from multiple experts, including a neurologist, neuropsychologist, and neuropsychiatrist, to fully understand the extent and impact of her injuries. The case presented additional complexity due to Marian’s varied professional background and the need to accurately assess how her injuries affected each and every aspect of her work and future earning potential.

A significant evidential exercise was also required. Marian had an extensive social media presence, and over 10,000 files were carefully reviewed and analysed to identify material relevant to her claim. In addition, Leigh examined and cross‑referenced video footage taken by others during the motorcycle tour. This material was organised and tabulated to help establish a clear picture of the events leading up to the accident.

Despite the Defendant maintaining a denial of liability, Leigh built a strong and detailed case. Through careful preparation, expert evidence, and a highly organised approach to managing large volumes of documentation, the claim ultimately settled.

The outcome

The successful settlement provided Marian with financial security and a sense of closure, enabling her to focus on her recovery and future.

Although Marian continues to manage the effects of her injury, her outlook is positive. With the legal process behind her, she is working towards regaining a sense of normality and finding ways to manage her ongoing symptoms.

She has also shown remarkable resilience and generosity by volunteering with the charity Headway, where she has been supporting other brain injury survivors by sharing her experiences and helping others navigate life after injury.
