Our client Jo* was passenger in a taxi arranged for her by a charity which supports the local community, including assisting older and vulnerable people to remain socially active such as by providing transport. During the ride, the driver started driving erratically, unexpectedly overtook a bus and crashed into some railings. It is believed that he suffered from a diabetic hypoglycaemic episode but as liability was admitted early we did not have to do thorough investigations in the causation of the accident.
Settling liability quickly meant that we could secure an initial needs assessment for Jo at an early stage and subsequently secure a rehab package to help with her injuries. The crash left her with multiple rib fractures, a fractured sternum and serious whiplash to the neck. These were all considered carefully by the case manager that put her plan together and Jo was grateful for the speed with which they all acted during her acute recovery phase. All Jo’s physical injuries were significantly improved or resolved within the next five months but during this time her cognitive health started declining and she was eventually diagnosed with Alzheimer’s. A medical report we commissioned from one of our experts stated that the accident exacerbated Jo’s future needs and accelerated her Alzheimer’s diagnosis by a couple of years so we included a level of provision for her future needs in the claim.
Jo had already been through enough and we collectively decided that commissioning further reports to fully support this argument meant we would take longer in settling her case which would not be in her best interests. Jo’s advanced age and already increased needs due to the Alzheimer’s meant she would benefit more from a quicker settlement to help her move on with her life.
The final settlement we agreed for Jo was more than our counsel’s advice of what we would likely achieve based on our existing documentation and that is testament to the good litigation skills of her lawyer Kieran who worked closely with the other side to help Jo access the support she needed.
