Enable Law client Graham* was cycling to watch a local running event when his accident occurred. As he rode past a line of parked cars, one vehicle’s door was suddenly opened directly into his path. With no time or space to react, Graham collided with the door and was thrown from his bike, sustaining serious injuries.

The impact of the accident

As a result of the accident, Graham suffered a fractured collarbone, significant chest and lung injuries including multiple rib fractures and a pneumothorax (collapsed lung), as well as a serious injury to his right knee. He required six days in intensive care and spent a further two weeks recovering in hospital.

Although Graham made progress in his recovery, some of his injuries continue to affect him. His clavicle injury still causes ongoing symptoms and surgery has been recommended, though due to his age this is not a route he feels able to pursue. He also continues to experience residual chest symptoms. The injury to Graham’s right knee proved particularly significant. Medical evidence confirmed that the accident had accelerated an underlying degenerative condition which had been entirely symptom-free before the collision. Experts advised that, without the accident, these symptoms may not have developed for another five to ten years, if at all. As a result, Graham went on to require a total knee replacement, the cost of which was included in the claim.

How Enable Law helped

Once liability was admitted, Associate Kieran Grainger worked quickly to arrange an Immediate Needs Assessment and secure early access to physiotherapy. This support focused on Graham’s shoulder and clavicle injuries and helped him regain independence as part of his recovery.

Enable Law secured compensation which was used to fund essential rehabilitation and physiotherapy. Kieran also coordinated Graham’s treatment arranging a case manager to assist with therapy arrangements, allowing him to focus on his recovery without the added stress of managing this himself.

Perhaps the most profound impact of the accident was on Graham’s lifestyle. Despite his age, he was extremely active and regularly competed in triathlons. The acceleration of his knee condition meant that he was ultimately forced to give up the sport altogether, something that no amount of rehabilitation could resolve.

After the case settled Graham said:

“My case was dealt with from beginning to end by Kieran Granger, who arranged everything for me, kept me informed, and gave me sound advice. I cannot speak highly enough of the service I received following a serious cycling accident.”
