This case tells the story of Robin*, a 75 year old, experienced cyclist whose life changed in an instant when he collided with a piece of rope that had been tied across a public road. The rope, placed there by the Defendant, caused Robin to fall from his bike with devastating consequences. The Defendant later admitted responsibility for the accident.

Robin’s injuries and their impact

The accident left Robin with catastrophic spinal injuries. He sustained fractures to his neck, spine and shoulder, along with damage to a major artery. These injuries resulted in permanent tetraplegia, meaning Robin now relies almost entirely on others for daily activities, personal care and mobility.

He also faces long‑term health risks, including recurring infections, breathing difficulties, pressure sores and ongoing pain. His bladder and bowel function are permanently affected, requiring medical devices and careful monitoring. Later, Robin developed a form of skin cancer, adding further complexity to his medical needs.

Despite these challenges, Robin has shown remarkable resilience and determination throughout his recovery.

How Enable Law became involved

Robin initially instructed another law firm, but his accommodation needs were not being progressed quickly enough. Given his age, medical condition and wish for his current home to be adapted, these delays were unacceptable.

Legal Director Tim Jones, supported by Associate Kieran Grainger, took over the case, prioritising the accommodation issues immediately and ensuring the adaptations he needed were pursued without delay by making an urgent application to the court which proved successful.

The struggle for suitable accommodation

Before the accident, Robin had lived in the same home for more than forty years and was deeply attached to it. After his injury, that home was no longer accessible or safe for him. He could no longer shower, move around independently or live with dignity in the space he knew so well.

Although he moved into temporary accommodation, it was never intended to be a long‑term solution. Robin needed significant adaptations to his original home—wider doorways, accessible bathroom facilities, specialist equipment and safe access for his carers.

However, early on, the Defendant refused to fund these essential works. This created long delays and left Robin living in unsuitable conditions. Tim Jones successfully applied to the court for an interim payment so that the first phase of adaptations could begin, allowing Robin to return home sooner while the legal dispute continued.

A second phase of adaptations was later agreed as part of the final settlement, ensuring Robin’s home will meet his needs for the rest of his life.

During the adaptation process, arrangements were also made for safe storage of the classic cars that had been an important part of Robin’s life before the accident.

Life after the settlement

The settlement secured for Robin has transformed his situation. Because of the funds obtained on his behalf, Robin now has:

  • A fully adapted home that allows him to live with safety, dignity and independence
  • Access to the specialist equipment he needs, including a powered wheelchair and bespoke assistive technology
  • Long‑term care, provided by a team of carers who support him day and night
  • Security and stability, knowing that his future care needs will continue to be met
  • The ability to live in the home he loves, surrounded by the familiar environment he had built over decades

Although Robin will always live with the consequences of his injuries, the outcome of the case means he can now focus on rebuilding his life with comfort, appropriate support and the reassurance that his essential needs will be met.

After the settlement, Robin said:

I had little input from the first team of Solicitors and then Tim Jones and Enable law, were suggested and then recommended to take over my case.

Tim started working with me some 2 years ago, and there was an immediate increase in information exchange and direction for the way forward. My life will never be the same as I went from an active athletic life, to a sedentary restrictive medical focused life, confined to a permanent motorised wheel chair.

On the bright side, Tim made life a lot easier by removing any financial worries and ensuring that anything needed was funded and obtained.

Now that my case has settled, not a quick job, I cannot thank Tim and Enable law enough for all their efforts. Some things I cannot change, but at least I can live comfortably in my own home, with the support I need and with no financial concerns.
