Craig* was involved in a serious road traffic collision and then went on to suffer avoidable complications due to negligent medical treatment. With specialist support from Enable Law, he secured a settlement that reflected the full impact of both the accident and the delayed diagnosis of his wrist injury.
Early support following the accident
On 10 October 2022, Craig was driving his truck to work when a skip lorry travelling in the opposite direction crossed into his lane and collided with him. He sustained multiple significant injuries, including a fractured humerus, a scaphoid fracture to his left wrist, a pelvis and right hip injury, bladder damage and concussion.
Craig initially instructed solicitors who valued his case at under £25,000 and began the matter in the Claims Portal. Liability for the road traffic collision was admitted early by the defendant’s insurer, allowing the case to progress.
A specialist hand surgeon later confirmed that the treating hospital had missed the fracture in Craig’s wrist and had not operated within the required window for fixation, leaving him with permanent pain and reduced function.
Realising he needed expertise across both personal injury and medical negligence, Craig instructed Stewart Young, Partner at Enable Law, who specialises in hybrid and cross‑over claims.
Rehabilitation and specialist treatment
Craig was struggling to work due to ongoing shoulder and wrist pain. As a self‑employed fencer, he relied heavily on his physical strength, and the accident left him uncertain about his long‑term ability to continue in his trade.
Enable Law secured rehabilitation funding from the defendant insurer under the Rehabilitation Code. This funding enabled two private wrist surgeries aimed at restoring as much function as possible while the claim progressed. Craig also received an interim payment to ease the financial pressures caused by his reduced earnings.
Medical evidence and assessing long-term impact
To understand the full extent of Craig’s injuries, Enable Law instructed a range of medical experts, including a hand surgery specialist and urologist.
The medical evidence confirmed that the delay in diagnosing and treating the scaphoid fracture significantly worsened Craig’s long‑term wrist function. Although surgery improved his symptoms, he remained restricted in the type of work he could undertake.
A Letter of Claim was served against the relevant NHS Trust for the negligent delay in treatment. Liability for this aspect of the claim was denied, but the evidence of avoidable harm informed the overall valuation of Craig’s losses.
Financial losses and the impact on Craig’s business
As a recently established self‑employed fencer, calculating Craig’s loss of earnings required careful analysis. A forensic accountant was instructed to review his business records and provide an expert assessment of his past and future losses.
Because Craig’s business was still developing, evidencing his likely future trajectory was more complex. Enable Law worked closely with the expert to present a clear, well‑supported claim reflecting Craig’s reduced earning capacity and the impact of his injuries on his long‑term employment prospects.
Settlement and outcome
Following negotiations with the defendant driver’s insurer, Craig’s claim settled for £450,000 in July 2025. This global settlement reflected all the injuries he sustained, including those arising from the negligent medical treatment.
Although Craig was eventually able to return to work, he had to move into a different role due to his permanent wrist limitations. The settlement will help provide stability and support for his future.
Client feedback
Craig left the following review following the conclusion of his claim:
“Stewart helped me with a personal injury claim from a car accident. His knowledge and understanding of the situation and help throughout were outstanding, always keeping me up to date with a very fast result in closing the claim. He is a very friendly approachable person who always made time for any queries I had, even out of standard hours, going above and beyond. Highly recommend Stewart and his company [Enable Law].”
