Understanding meningitis

Meningitis is an infection of the protective membranes surrounding the central nervous system. It can be very serious if not treated quickly. Babies, children and young people are particularly at risk.

Bacterial meningitis and meningococcal disease can cause serious harm if not treated. So medical professionals are trained to look out for it. As soon they suspect meningitis or septicaemia, they should treat promptly. People with bacterial meningitis usually make a full recovery. However, without treatment, the illness will become more severe. It can cause long term problems or even death.

Some of the common mistakes we see in relation to meningitis care include:

  • Not recognising meningitis symptoms and delaying treatment
  • Not asking the right questions – or enough questions
  • Not treating meningitis as quickly as necessary and in the right way
  • Not checking the medical history before beginning treatment
  • Not monitoring progress and adjusting treatment.

Your rights and eligibility

If you have concerns about the medical care you or someone you love had , you are entitled to answers and explanations.

Part of our job as meningitis solicitors is to investigate whether your clinicians followed National Institute for Health and Care Excellence (NICE) guidelines and gave reasonable care.

If care was poor and caused avoidable and/or additional suffering, we can help you claim compensation.

How can compensation help?

No amount of money can relieve serious long term harm to health or disabilities but having the funds to access the right support and equipment can make life easier.

Where someone has long term health needs after meningitis, compensation may help to meet those needs. This can include support, equipment, therapy, home adaptations or re-housing, or support from a carer.

If you lost someone you love to meningitis after negligent care, you may be able to claim on the behalf of their dependents to help meet the financial pressures on them. That may give them one less thing to worry about as they grieve.

Meningitis compensation FAQs

Levels of compensation for meningitis negligence can be high. The amount will depend on the harm done by meningitis (general damages), the costs of caring for them and of the the equipment or adaptations they need (special damages)

For an adult, the time limit is three years. For a child it is until their 21st birthday. For someone with mental capacity, there may be no time limit at all.

Even if you think the time limit has passed, it is still worth contacting us. There are exceptions to these rules and you still have a chance to claim.

This depends on a number of factors; whether liability is admitted; how your opponent manages the claim; nature of your injury and rehabilitation needs. It is rare for a case to take less than a year and is more likely to take several years. However, we will try to speed your case through as quickly and effectively as possible.
