Understanding bicycle accidents

Accidents happen when cyclists share spaces with other road users, and collisions can involve cars, pedestrians, HGVs and other cyclists.

Cyclists are amongst the most vulnerable road users, with much higher casualty rates than all other types of road user, apart from motorcyclists. Sadly, when involved in collisions, cyclists can suffer very serious injuries that may require lifelong care. This could include spinal and brain injuries or serious fractures injuries.  There can be a psychological impact too, as their injuries may lead them to develop PTSD or other psychological injuries.

Your rights and eligibility

You may have a valid claim if someone else was wholly or partially at fault for the accident that hurt you or a loved one.

The person at fault could be another road user, the authority responsible for maintaining a road or the manufacturer of the cycling equipment you use.

Claims we can help with include cyclists hurt due to:

  • collisions with other vehicles
  • a vehicle door being opened in their path
  • pedestrians stepping out in front of them
  • hit and run incidents where the other vehicle does not stop at the scene
  • poor road surfacing, road markings or signage on roads or cycle paths
  • defective equipment such as bike helmets.

How can compensation help?

Compensation can help to pay for ongoing care, treatment, rehabilitation and aids to make an injured person’s life more manageable. This could include:

  • Any specialist medical treatment or medication
  • Physical therapies and rehabilitation
  • Counselling for associated trauma
  • Loss of earnings

The process of making a claim can also help to reveal exactly what happened during an accident. It may also highlight dangers to other people to prevent them from suffering in the same way.

Bicycle accident compensation FAQs

This depends on the injuries suffered and the long-term implications of those.

Injuries suffered by cyclists are extremely wide-ranging and the compensation achieved differs.

Compensation is usually made up of two elements – general damages and special damages.

General damages are usually limited by guidelines and previous cases. They are intended to compensate for the pain and inconvenience that you’ve been through.

Special damages are more personal to you and can mean claims go up to very high figures depending on the nature of the injury suffered and level of need going forward. In the case of a very serious injury, if someone needed an adapted home or lifelong care as a result of their injury, for example, special damages may be extremely high and run to millions of pounds.

A specialist solicitor will know of the best treatments and aids available to help you cope with life after your injury. They will discuss these with you and seek to secure compensation to cover the costs involved in accessing them.

As a rule of thumb, the more complex the injuries suffered the longer a claim is likely to take. This is because it is vital to understand and provide evidence for all the long-term needs that may arise because of the injury. The compensation should address all the costs involved in these.

Another factor that may make a case take longer is if the person responsible for the injuries does not accept the blame.

Most cases can be settled via negotiations out-of-court. In some cases, it will be necessary to go to court. Our experienced solicitors will support you every step of the way.

We fully understand that some needs can not wait for the final settlement of a case to be met. For that reason we do our best to help secure interim payments to meet these urgent needs. These are quick payments you may be able to receive before the claim settles to meet your immediate needs and can cover things like therapies, rehabilitation or even house adaptations that you need to start getting your life back on track.

If the accident was truly entirely your fault you cannot claim, but it is important to be aware that sometimes blame can be shared.

You may feel you are fully or partly to blame for an accident but if you’ve suffered the consequences of it, it is important to consider if the blame was partially shared. Get in touch and we’ll help you find out.

It is possible to make a claim in hit and run cases.

Following an investigation, it may be possible to trace the driver involved and claim from their insurance, if they have it.

A specialist scheme exists to allow people to claim compensation when they have been involved in a collision with an uninsured or untraced driver. Enable Law can help with these claims which are made via the Motor Insurers’ Bureau (MIB).

As in any cycling claim, having a specialist solicitor on your side makes a big difference as they will ensure all aspects of your injury are understood and seek maximum compensation to cover all costs you have incurred and may incur in the future.
